Please read these Terms and Conditions carefully before placing an order. By purchasing from Tools-Paint.com, you agree to be bound by these terms.
1. Definitions
“Company”, “we”, “us”, “our” – Avenue Group Ltd trading as Tools-Paint.com.
“Website” – www.tools-paint.com
.“Customer”, “you”, “your” – any individual, business, or organisation placing an order with us.
“Goods” – any products supplied by us to you.
“Contract” – any agreement formed between you and us for the supply of Goods.
2. Professional Use Products and Customer Confirmation
Many of the coatings, paints, and chemical products supplied through Tools-Paint.com are for professional or industrial use only.
By ticking the confirmation box at checkout, the Customer acknowledges that:
• They are a competent professional user familiar with correct application methods, hazards, and safe handling procedures.
• They have read and understood the technical data sheet (TDS) and safety data sheet (SDS) for each product.
• They assume full responsibility for ensuring the Goods are suitable for their intended application.
We reserve the right to cancel any order where professional competence cannot be confirmed.
3. Ordering
3.1. Orders are placed via our Website. You are responsible for ensuring all order details are accurate.
3.2. We reserve the right to accept or reject any order. A Contract is formed once we issue a dispatch confirmation.
3.3. Images and descriptions are provided as guidance only. Colours, finishes, or packaging may vary.
4. Pricing and Payment
4.1. Prices shown predominantly exclude VAT; VAT-inclusive prices are also displayed.
4.2. Payment must be made in full at the time of ordering.
4.3. Prices may change without notice. The price payable is the price displayed at the time of order.
5. Delivery
5.1. Delivery dates are estimates only. Delays may occur outside our control.
5.2. Risk in the Goods passes to you upon delivery.
5.3. Delivery charges are shown at checkout. Extra charges may apply for remote locations or specialist items.
5.4. You must inspect Goods upon delivery and report any issues within 48 hours.
6. Click & Collect / Trade Counter Collection
6.1. Collection is available from our trade counter where indicated.
6.2. Do not collect your order until you have received confirmation.
6.3. Proof of purchase may be required.
7. Returns and Cancellations
7.1. Consumer Customers
You may cancel your order within 14 days of receiving the Goods, provided items are unopened, unused, and resaleable.
7.2. Business Customers
Business-to-business sales are final. Returns are accepted at our discretion and may incur restocking charges.
7.3. Exclusions
Returns cannot be accepted for:
• Mixed paint, tinted colours, or custom-made products.
• Hazardous materials where regulations prevent return.
• Items opened, used, or damaged after delivery.
7.4. Return Procedure
Return requests must be submitted in writing. Goods must be returned at the customer’s expense unless defective.
8. Warranty and Product Suitability
8.1. The Customer is responsible for determining suitability of products.
8.2. Technical recommendations are given in good faith but are not guarantees of performance.
8.3. Products must be applied in accordance with the manufacturer’s TDS and SDS.
9. Liability
9.1. Our liability is limited to the value of the Goods supplied.
9.2. We are not liable for loss of profits, business interruption, misuse, incorrect application, or failure to follow TDS/SDS guidance.
9.3 .Nothing excludes liability for death or personal injury caused by our negligence.
10. Shortages, Errors, and Damaged Goods
10.1. Any shortages or incorrect items must be reported within 48 hours of delivery.
10.2. Claims raised after this period may not be accepted.
10.3. Photographic evidence may be required for damaged goods.
11. Cancellation by Us
We may cancel an order if a product becomes unavailable, the Customer is not competent to use a professional-grade product, fraud is suspected, or pricing/technical errors occur.
A full refund will be issued where applicable.
12. Force Majeure
We are not liable for delays or failure to perform due to events outside our control, including strikes, transport issues, supply shortages, accidents, or natural events.
13. Intellectual Property
All Website content remains the property of Avenue Group Ltd and its licensors. Reproduction without permission is prohibited.
14. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Disputes fall under the exclusive jurisdiction of the English courts.
